Terms of Service for StudyTreat (studytreat.com)

1. Acceptance of Terms

By accessing or using StudyTreat (the “Service”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the Service, including visitors to the website, users of the progressive web app (PWA), and mobile app users. If you do not agree with these Terms, you must not use the Service. If you are under the age of majority in your jurisdiction (for example, under 18 years old), you must have permission from a parent or legal guardian to use the Service, and by using the Service, you confirm that such permission has been obtained.

2. Description of the Service

StudyTreat (accessible at studytreat.com and through our mobile/PWA applications) is a platform for creating, sharing, and studying educational learning materials such as flashcards, quizzes, and other study resources (collectively, “Learning Materials”). The Service enables users to build collections of these Learning Materials and share them with others. Content on the platform can be designated as private, public, or community (wiki-style) collections, as defined below. StudyTreat is currently free to use; however, we may offer paid premium features in the future (see Section 8 on Premium Features). Our mission is to provide a safe and appropriate learning environment for users of all ages, including young students.

Unless we explicitly say otherwise, references to “flashcards” or “cards” in these Terms should be understood to include all Learning Materials you create on or upload to the Service, including quizzes and any future study formats we may support.

3. Account Registration and Security

3.1 Registration: To create, save, or share content, you need to register an account. You may register using Google Single Sign-On (SSO) or other methods we may support. When you sign in with Google SSO, you allow us to access certain information from your Google account, such as your name and email address. You agree to provide accurate and current information during registration and to keep your account information updated.

3.2 Account Requirements: You are responsible for maintaining the confidentiality of your account credentials. Keep your Google account secure and do not share your login credentials with others. You are responsible for all activities that occur under your StudyTreat account. If you believe your account has been accessed without authorization, notify us immediately. You may not impersonate anyone or create an account for someone else without permission. Each user should have only one account, and accounts should not be shared between multiple individuals.

3.3 Eligibility of Minors: The Service is intended for general audiences. If you are under the age of 13 (or the minimum age required by laws in your country for online services), you should only use the Service with involvement and consent of a parent or legal guardian. We do not knowingly collect personal information from children under 13 without parental consent. Parents and guardians are responsible for monitoring their minor children’s use of the Service.

4. User-Generated Content and Ownership

4.1 User Content Definition: “User Content” means any text, images, graphics, audio, video, interactive elements, or other material that users create, upload, post, or otherwise make available on the Service. This includes, for example, the content of flashcards, quizzes, study guides, decks, collections, titles, descriptions, comments, and any contributions to community collections.

4.2 Ownership: You retain all rights and ownership of the User Content you create on StudyTreat. We do not claim ownership of your original educational content. However, by submitting or posting User Content on the Service, you give us certain rights to that content as described in Section 4.3 (License Grant) below. Aside from the license you grant to us and other users (explained below), you are free to use your content in any way outside the Service.

4.3 License Grant to StudyTreat: By creating or uploading User Content on the Service, you grant StudyTreat a worldwide, non‑exclusive, royalty‑free, sub‑licensable and transferable license to use, host, store, reproduce, modify (for technical adaptations like formatting or compatibility), display, perform, distribute, and create derivative works of your content solely for the purpose of operating, improving, and promoting the Service. This means, for example, we have your permission to display your public Learning Materials to other users, to adapt your content to different device screens, or to include thumbnail images of your public materials in a promotional feature on our homepage. We will not sell your User Content or use it outside of providing and marketing the StudyTreat Service without your permission.

4.4 Duration of License: This license lasts as long as your User Content is available on our Service and for a reasonable period of time afterward (for example, to allow our backup systems to update or to enable continued use of community-contributed content). If you remove your User Content or delete your account, we will cease public display of your removed content within a reasonable timeframe. However, you acknowledge that (a) residual copies of deleted content may remain in our backup systems for a period of time; and (b) any User Content that was shared with others (for example, if another user copied your public Learning Materials into their collection, or if you contributed to a community deck) may continue to be used by those users or remain on the Service. Community content contributions in particular (see Section 5.3) may remain available to other contributors even after you leave the platform, and the license you granted for such content is not automatically revoked by account deletion.

4.5 User Content Responsibilities: You are solely responsible for all content you create or upload. By posting User Content on StudyTreat, you represent and warrant that:

  • You own or have all necessary rights, licenses, and permissions to post the content and to grant the licenses in these Terms.
  • Your content does not infringe or violate the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party.
  • Your content does not contain any confidential information or personal data of others that you do not have consent to disclose.
  • Your content and your use of the Service comply with all applicable laws and regulations and these Terms (including the Content Guidelines in Section 6).
  • Your content is appropriate for a general audience (including children), meaning it does not contain prohibited material as described in Section 6.2 below.

StudyTreat is not responsible for any User Content, and we do not endorse any opinion, recommendation, or advice expressed by users on the platform. You understand that when using the Service, you may be exposed to content from a variety of users, and that content might not always be accurate or complete. You agree to use the content on the Service at your own risk.

4.6 Monitoring and Enforcement: We have the right (but not the obligation) to review, screen, or monitor any User Content on the Service at any time to ensure compliance with these Terms and to maintain a safe platform. We reserve the right to refuse to host, remove, or disable access to any content for any reason, including if we, in our sole judgment, determine that the content violates these Terms or is otherwise objectionable. We may also suspend or terminate accounts associated with such content (see Section 11 on Termination). However, ultimate responsibility for the content rests with you, the user. If you find content that violates our Terms or is harmful, please report it to us (see Contact Information in Section 14).

5. Content Types: Private, Public, and Community

StudyTreat provides flexibility in how you share your educational materials. When creating content, you can choose different visibility settings:

5.1 Private Content: You may keep your Learning Materials private. Private content is visible only to you (and those you explicitly share it with, if a feature such as sharing via link or password‑protection is available). We will not disclose your private content to others without your direction, except as required by law or for safety (for example, if private content is reported to us for violating our Terms). Even though private content is not publicly visible, it must still comply with our Content Guidelines (Section 6) — for example, harmful illegal material is not permitted anywhere on the platform, even in private form. We also may access and view private content for debugging, safety checks, or at your request (e.g., for support), but we will treat it with confidentiality.

5.2 Public Content: If you choose to make your Learning Materials public, they will be visible to all users of the Service and potentially to others on the internet. Public content may appear in search results, community feeds, or be featured by StudyTreat to highlight user creations. By marking content as public, you allow other users to view and use your content for their own learning. Other users might be able to copy your public Learning Materials into their own collections or share links to your content. If you do not want others to have access to your work, keep it private. We are not responsible for how other users may use or misinterpret your public content, but we expect all users to respect the intent of sharing (e.g., personal study and not plagiarism or misuse).

5.3 Community (Wiki‑Style) Content: The Service may offer “community” collections or materials that are collaboratively created and managed by multiple users. Community content is designed to be edited and improved by the community:

  • Contributing: If you create or contribute to a community collection, you understand that other trusted users may modify, add to, or delete portions of that content. You agree that your contributions can be edited or re‑purposed by others in the community.
  • License to Others: By contributing to a community material or deck, you grant all other users of the Service a non‑exclusive license to use, reproduce, modify, and share your contributions as part of that community content. This license to other users is granted under the same terms as the license you give to us (Section 4.3) and is necessary so that the community project can function. In essence, community contributions are made for the benefit of all users.
  • Attribution: While we encourage proper credit, we cannot guarantee you will be individually credited as the author of specific content in a collaboratively edited collection. Contributions may be tracked by user account internally, but public attribution might be given to the community or collection as a whole.
  • No Exclusive Control: Once you contribute content to a community project, you may not be able to unilaterally remove it. If you decide to stop participating or delete your account, your past contributions to community sets might remain available as part of those sets (they are licensed for continued use by us and other users per Section 4.4). If you have concerns about a community project or want your specific contribution removed, please contact us and we will consider the request, but we reserve the right to keep the content available if it’s integral to the community resource.

Community features are meant to harness collaborative knowledge for education. Please engage in good faith, and only contribute content that is accurate to the best of your knowledge and appropriate for all ages.

6. Acceptable Use and Content Guidelines

We are committed to keeping StudyTreat a safe, respectful, and lawful place for learning. By using the Service, you agree to follow these acceptable use rules and content standards:

6.1 General Acceptable Use: You agree that you will not misuse the Service or help anyone else to do so. In particular, you will not:

  • Use the Service for any unlawful purpose or to promote illegal activities.
  • Attempt to hack, attack, disrupt, disable, or interfere with the proper working of the Service or any other person’s use of the Service. This includes not engaging in denial-of-service attacks, spreading viruses or malware, attempting to bypass security measures, or probing or scanning the vulnerability of any system.
  • Access or attempt to access accounts or data that you are not authorized to access. Do not harvest or scrape information from the Service in an automated manner (for example, using bots or scripts) without our permission.
  • Engage in any form of harassment, bullying, or stalking of other users on the Service. This includes not using the Service’s communication tools to send spam, unsolicited advertising, or any form of unwanted messages.
  • Impersonate any person or organization, or misrepresent your affiliation with anyone, when using the Service.
  • Use the Service to distribute or store any content that contains software viruses, worms, Trojan horses, or any other harmful computer code.
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service or any related software, except to the extent that such activity is expressly permitted by law.

6.2 Prohibited Content: You must not create, upload, share, or store content that is objectionable or inappropriate. Any User Content that falls into the following categories is strictly prohibited on StudyTreat:

  • Hateful or Harassing Content: Content that attacks, bullies, or incites violence against individuals or groups on the basis of race, ethnicity, religion, sex, gender, sexual orientation, disability, or any other characteristic that is commonly associated with discrimination or marginalization. Slurs, threats, or content that encourages hate or harassment are not allowed.
  • Graphic or Violent Content: Extremely graphic, gruesome, or violent content, particularly if it is not presented in an educational or age-appropriate context. Any content that promotes or glorifies violence, self-harm, or harm to others is forbidden. (Historical or educational content involving violence must be presented with appropriate context and sensitivity.)
  • Sexual or Pornographic Content: Any pornography or sexually explicit material. Content containing nudity or sexual themes is not allowed, especially given that children use the Service. (Limited exceptions might apply for purely educational diagrams or anatomy in appropriate, non-explicit context, but if in doubt, do not upload it.)
  • Harmful or Dangerous Content: Instructions or depictions that facilitate the planning or execution of violent or illegal activities. Content that encourages dangerous or irresponsible behavior, self-harm, suicide, or eating disorders. We do not allow content that could directly lead to serious harm.
  • Illegal Content: Any content whose creation, possession, or distribution is illegal under applicable law – for example, material depicting child exploitation (which we will report to authorities), illegally pirated content, or others’ private information posted without consent. Also, do not use the Service for any fraudulent or deceptive activities.
  • Copyrighted or Infringing Materials: Do not upload content that you do not have the rights to use. This includes text, images, or media taken from books, websites, or other sources that are copyrighted, unless you have permission or a legal right (such as the content being public domain or used under fair use exceptions). Respect intellectual property rights of others. If you use small excerpts or images under fair use or educational use, ensure it truly meets those legal standards.
  • Personal Data and Privacy Violations: Do not post sensitive personal information of others without consent. This includes things like addresses, phone numbers, Social Security numbers, financial information, or personal data about children other than your own (if you’re a parent/teacher using the Service). Protect everyone’s privacy.
  • Spam and Advertising: The Service is for educational content, not for unsolicited advertising or spam. Do not use the platform to advertise products or services outside of relevant educational context, and do not create mass-produced irrelevant content or repetitive posts. Also, no content that is solely promotional or a scam.
  • Malicious or Deceptive Content: Content that is intentionally misleading (like hoaxes or misinformation that could cause harm), phishing attempts, or any attempt to trick users into revealing sensitive information is prohibited.

These content rules apply to all content on StudyTreat, whether it’s publicly posted, privately stored, or shared in a community collection. We reserve the right to remove or block access to any content that violates these guidelines, and to take appropriate action against the offending account (which may include warnings, suspension, or termination of access).

6.3 Reporting Violations: If you encounter any content or user behavior that you believe violates these Terms or our guidelines, please report it to us. You can contact us via the methods provided in Section 14 (Contact Information). We will review reports promptly and take action as needed to enforce these Terms. Users who repeatedly violate content standards or acceptable use rules may have their accounts terminated.

7. Privacy and Data Use

Your privacy is important to us. By using StudyTreat, you agree to the collection and use of your data as outlined here and in our Privacy Policy (if available separately):

7.1 Personal Information: When you register and use the Service, we may collect certain personal information such as your name, email address, and any profile details you provide. If you use Google SSO, we receive personal data from your Google account (like your Google profile name and email). We use this information to identify you on the platform, to communicate with you about your account, and to provide the features of the Service (for example, saving your content and progress).

7.2 Usage Data: We also collect data about how you use the Service (e.g., the flashcards you create, study statistics, login times, device information, and general usage patterns). This data helps us improve our platform, fix bugs, understand which features are useful, and make StudyTreat better for learning.

7.3 Cookies and Tracking: Our website may use cookies or similar technologies to remember your preferences, keep you logged in, and gather analytics about usage. We may use third-party analytics services (such as Google Analytics or similar tools) to help us understand traffic and usage. These third-parties may set their own cookies or identifiers to collect information such as your IP address, browser type, pages visited, and time spent. This information is generally used in aggregate form to analyze trends and improve the Service.

7.4 How We Use Your Data: The personal information and usage data we collect are used to operate and maintain the Service (e.g., to save your flashcards and show them when you log in), to communicate with you (e.g., sending important account or transactional emails, updates about changes to the Service or Terms), and to improve and personalize your experience (e.g., recommending relevant public flashcard sets). We do not sell your personal information to third parties. We will not share your personal data with third parties for their own marketing purposes without your consent.

7.5 Data Protection: We implement reasonable security measures to protect your information from unauthorized access or disclosure. However, no online service can guarantee 100% security. You agree that you will use appropriate caution when sharing data on any online platform. StudyTreat will not be liable for any unauthorized access or hacking, though we will notify users and authorities as required by law in the event of a data breach.

7.6 Account and Data Deletion: You have the right to delete your account and personal data from StudyTreat. You can request account deletion through your account settings (if available) or by contacting us (see Section 14). Upon verification of your request, we will delete or anonymize your personal information and User Content from active databases within a reasonable time. Note that (as mentioned in Section 4.4) certain residual data may remain in backups for a period of time, and any content you made public or contributed to community collections may persist to serve other users unless removal is legally required. We also may retain certain information if necessary for legal obligations, dispute resolution, or enforcement of our agreements (for example, we might keep a record of a user’s ban for violating Terms to prevent reuse).

8. Premium Features and Payments

8.1 Free Service with Future Premium Options: StudyTreat is currently provided to you free of charge. All basic features for creating and studying flashcards are available without any fee. In the future, we may introduce optional premium features or subscription plans that offer enhanced functionality or content for a fee. We will clearly communicate any introduction of paid features, including pricing and terms, before they are available.

8.2 No Charges Without Consent: You will not be charged for any service unless you opt-in and explicitly agree to a purchase or subscription. Should you choose to subscribe to a premium plan or make a purchase in the future, you will be presented with applicable terms (such as payment amount, billing frequency, and cancellation policy) at that time.

8.3 Payment Terms (For Future Use): If and when premium features are offered:

  • Fees: You agree to pay any applicable fees for the premium services you subscribe to, as communicated to you at the time of subscription. Prices are subject to change, but any changes will be communicated in advance and will not apply retroactively to your current subscription period without your agreement.
  • Billing: Paid subscriptions may be billed in advance on a recurring basis (e.g., monthly or annually) depending on the plan. By providing a payment method, you authorize StudyTreat (or our third-party payment processor) to charge the applicable fees to your payment instrument.
  • Cancellation: You can cancel a subscription according to the procedure we will provide (likely through your account settings or contacting support). If you cancel, you will typically continue to have access to premium features until the end of your pre-paid subscription term, and the subscription will not auto-renew afterward. We will provide details on our refund policy (if any) when we introduce paid plans. Generally, fees are non-refundable except where required by law or explicitly stated otherwise.
  • Failure to Pay: If payment cannot be processed (e.g., an expired credit card) or is not received for a premium account, we reserve the right to downgrade or suspend the premium features associated with your account until payment is resolved. We will attempt to notify you to correct the issue.

8.4 Free Trials and Promotions: We may offer limited-time free trials or promotional offers for premium features. Such offers are subject to these Terms as well as any additional terms of the promotion. We reserve the right to modify or terminate any trial or promotion at any time, in accordance with applicable law.

Remember, any introduction of paid features will be accompanied by an update to these Terms or an additional terms document, and you will have the opportunity to review those before committing to any payment.

9. Intellectual Property Rights

9.1 StudyTreat’s Intellectual Property: Aside from User Content, all materials and content provided by StudyTreat through the Service are the property of the Service or its licensors. This includes, but is not limited to, the software and code that operates the platform, the design, layout, and look-and-feel of the applications, our trademarks, logos, graphics, compilations of learning content (that we provide), and any content created by our team (such as help articles, default categories, etc.). These are protected by copyright, trademark, and other intellectual property laws. StudyTreat grants you a limited, revocable, non-exclusive, non-transferable license to use the Service and its content for your personal, non-commercial educational use, in accordance with these Terms. You may not copy, distribute, modify, or create derivative works of our proprietary content or technology without our explicit written consent, except as allowed by law.

9.2 Feedback: If you choose to provide feedback, suggestions, or ideas regarding improvements or new features for StudyTreat (“Feedback”), you agree that we are free to use your Feedback in any manner, including incorporating it into the Service or product, without any obligation to you. Feedback is entirely voluntary, and we may use it without compensating you or crediting you, and without any confidentiality restriction.

9.3 User Content License to Others: This is a reminder of what was stated in Sections 4 and 5: if you share content publicly or in community areas, you are allowing other users to access and use that content. For public content, this means other users can view and possibly copy or reference your content for their own personal learning. For community content, this means others can edit and reuse your contributions. While this does not transfer ownership to them, it does mean you have given them permission as part of the platform’s collaborative nature. If you do not want to grant such permissions to users, keep your content private.

9.4 Copyright Infringement (DMCA) Policy: StudyTreat respects intellectual property rights and expects users to do the same. If you believe that any content on the Service infringes your copyright or other intellectual property rights, please notify us via the contact information in Section 14 with the following information:

  • A description of the copyrighted work or other IP that you claim has been infringed.
  • A description of where the material you claim is infringing is located on our Service (a URL or search query that would allow us to find it).
  • Your name, address, email, and a statement that you have a good-faith belief that the use of the material is not authorized by the owner, its agent, or the law.
  • A statement that the information you have provided is accurate, and (if it’s a copyright issue) that you are the copyright owner or authorized to act on the owner’s behalf.
  • An electronic or physical signature of the person authorized to act on behalf of the rights owner.

Upon receiving a complete and valid notice, we will review and remove the reported content as appropriate, and may notify the user who posted it. We also reserve the right to terminate accounts of repeat infringers when appropriate. (Note: If applicable, StudyTreat will comply with the Digital Millennium Copyright Act (DMCA) and other similar laws; the above process is intended to meet those requirements.)

10. Disclaimer of Warranties

StudyTreat is provided on an “as is” and “as available” basis. While we strive to provide a great service, we make no warranties or guarantees about the Service. To the fullest extent permitted by applicable law, StudyTreat (and its parent, affiliates, suppliers, and partners) disclaims any and all warranties, whether express, implied, or statutory, regarding the Service. This includes, but is not limited to:

  • Merchantability & Fitness: We do not guarantee that the Service is fit for a particular purpose or that it meets your needs. (For example, we don’t warrant that using our flashcards will guarantee you achieve certain educational results or grades.)
  • Accuracy of Content: We are not responsible for the accuracy, reliability, or quality of the content posted by users. We do not warrant that any study materials or answers on the platform are correct or up-to-date. Use educational content at your own discretion.
  • Availability: We do not promise that the Service will be uninterrupted, timely, secure, or error-free. There may be times when the Service is down for maintenance or due to technical issues. We will attempt to fix issues promptly, but we make no guarantee of uptime or that the Service will be free from loss, corruption, attacks, viruses, or other harmful components.
  • No Implied Warranties: Any implied warranties (such as implied warranty of merchantability, fitness for a particular purpose, non-infringement) are expressly disclaimed. Some jurisdictions do not allow the disclaimer of certain warranties, so some of these disclaimers may not apply to you in full — in such cases, the duration of any required warranties will be the minimum permitted by law.

You understand that use of the Service is at your own risk. You are solely responsible for any damage to your device or loss of data that results from any material downloaded from the Service. No advice or information (oral or written) obtained from StudyTreat or through the Service will create any warranty not expressly stated in these Terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will StudyTreat, its owners, affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) the Service or these Terms. This includes, without limitation, any loss of profits, loss of data, business interruption, damage to goodwill, or the cost of substitute services, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion of certain damages, our liability will be limited to the fullest extent permitted by law.

Cap on Liability: To the extent permitted by law, the total liability of StudyTreat and its affiliates for any claims arising out of or relating to the use of the Service or these Terms is limited to the amount you have paid us in the last six (6) months, or USD \$50, whichever is greater. (If you have not paid anything, our liability is capped at \$50.) This limitation applies whether the claims are based on warranty, contract, tort (including negligence), or any other legal theory.

User Content and Third-Party Conduct: You specifically acknowledge that StudyTreat is not liable for content provided by third parties or other users, or for the defamatory, offensive, or illegal conduct of any third party, and that any risk of harm or damage from the foregoing rests entirely with you. The Service is a platform for user-generated content; we are not responsible for what users post, though we try to moderate inappropriate content as described in these Terms.

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so certain limitations stated above may not apply to you. In such jurisdictions, our liability shall be limited to the smallest amount permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless StudyTreat, its parent company, affiliates, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise out of or relate to:

  • Your use or misuse of the Service;
  • Your violation of any of these Terms;
  • Your violation of any rights of a third party, including any intellectual property, privacy, publicity, or other proprietary right; or
  • Any content you post or share on the Service, including any claim that your content caused damage to a third party (such as claims that your content is infringing or defamatory).

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that case, you agree to cooperate with our defense of such claim and you may not settle the matter without our prior written consent. This indemnification obligation will survive any termination of your account or these Terms.

13. Termination and Suspension

13.1 By You (Account Deletion): You are free to stop using StudyTreat at any time. You may delete your account at any time by following the procedures in the Service or contacting us with your request (see Section 14 for contact). Account deletion will typically involve removing your profile information and personal data from our active systems, and either deleting or anonymizing your User Content. Note that as described in Sections 4.4 and 5.3, content you contributed that was shared with others (public or community content) may persist on the platform for the benefit of other users; in such cases, we may disassociate it from your deleted account, but not entirely erase it if it remains relevant to others’ learning materials, unless required by law.

13.2 By StudyTreat (Termination or Suspension): We reserve the right to suspend or terminate your access to the Service (or certain features of the Service) at any time, with or without notice, if we believe you have violated these Terms, violated the law, or in our sole discretion to protect the integrity of the platform (for example, if you are engaging in misuse that could harm others or the Service). We may also suspend or terminate the Service or any part of it, or your account, for operational reasons (for example, if we discontinue the Service). In the event of termination or suspension, you may lose access to your account and content. We may notify you of the reason for termination or suspension, but we are not obligated to provide notice or an opportunity to cure violations in all cases (for example, a serious violation may result in immediate termination without notice).

13.3 Effect of Termination: Upon termination of your account, whether by you or us:

  • Your right to use the Service will immediately cease. You must cease all use of the Service and you may lose access to your account and all data associated with it.
  • We may delete or deactivate your account and prevent further access to the Service by your account credentials.
  • Any licenses you granted to us with respect to your User Content will continue as described in Section 4.4 to the extent that we need to fulfill any ongoing obligations (for example, to other users who have copies of your public content, or as part of legal record-keeping). However, generally if your account is deleted or terminated, we will remove your personal profile and make your personal User Content inaccessible in the ordinary course (except as noted for content that persists for others).
  • Sections of these Terms that by their nature should survive termination (such as Indemnification, Disclaimers, Limitations of Liability, and Governing Law) will survive.

StudyTreat shall not be liable to you or any third-party for termination of your account or access to the Service, or for the deletion of your content, provided such termination/deletion is in accordance with these Terms. If we terminate the Service in its entirety, we will endeavor to provide advance notice to users and, if applicable, refund any prepaid fees for premium services that extend beyond the termination date (if those exist at the time).

14. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which StudyTreat operates, without regard to its conflict of law principles, except where overridden by applicable mandatory consumer protection laws of your own jurisdiction. We aim to make the Service available globally and comply with local laws; however, we make no representation that the Service is appropriate or available in all locations. If you access the Service, you do so at your own initiative and are responsible for compliance with any local laws.

In the event of any dispute or claim arising out of or relating to these Terms or your use of the Service:

  • Contact Us First: We encourage you to contact us (see contact information below) to attempt to resolve any issue informally. We value our users and will try to address your concerns without the need for legal action.
  • Jurisdiction and Venue: If a dispute cannot be resolved informally, and unless otherwise required by applicable law, any legal action or proceeding relating to these Terms or the Service shall be brought in the competent courts of the jurisdiction where our company is based. By using the Service, you consent to the personal jurisdiction of such courts. (If StudyTreat is not tied to a specific country in this placeholder scenario, this clause may be adjusted once a governing jurisdiction is chosen.)
  • Injunctive Relief: Notwithstanding the above, you agree that StudyTreat may seek injunctive remedies (such as a court order to stop you from doing something) in any jurisdiction if you have violated or threatened to violate our intellectual property or other important rights.

If we make material changes, we will notify users by posting the updated Terms on our website (and/or through the app) and updating the “Last Updated” date at the top of this document. In some cases, especially if changes are significant, we may provide additional notice to you (such as via email or a pop-up notification).

Your Continued Use: By continuing to access or use the Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new terms, you must stop using the Service and, if applicable, delete your account. We encourage you to periodically review the Terms to stay informed of any updates.

16. Miscellaneous

16.1 Entire Agreement: These Terms (along with any additional guidelines, rules, or terms expressly incorporated by reference, such as a Privacy Policy or any specific rules for particular features) constitute the entire agreement between you and StudyTreat regarding your use of the Service. They supersede any prior agreements or communications between you and us relating to the Service. Any additional or different terms you propose (for example, in a purchase order or email) are expressly rejected and will not become part of our agreement unless we explicitly agree in writing.

16.2 Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be modified or eliminated to the minimum extent necessary so that the rest of these Terms remain enforceable and in effect. In other words, the invalidity of one part of the Terms does not affect the validity of the remainder of the Terms.

16.3 No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of StudyTreat.

16.4 Assignment: You may not assign or transfer these Terms (or any of your rights or obligations under these Terms) without our prior written consent. We may assign or transfer our obligations and rights under these Terms to an affiliate or in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the respective successors and permitted assigns of the parties.

16.5 No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights. The agreement is between you and StudyTreat only.

16.6 Relationship of Parties: You and StudyTreat are independent contractors. These Terms do not create a partnership, franchise, joint venture, agency, or fiduciary or employment relationship between the parties.

16.7 Headings and Interpretation: Section headings in these Terms are for convenience only and have no legal effect. In these Terms, “including” means “including without limitation.”

16.8 Language: These Terms are written in English. If these Terms are translated into another language, the English text shall govern to the extent of any conflict.
